Divorce

At The Legal Consortium, led by Ms. Ashu Yadav, we provide sensitive yet strong legal support in divorce and matrimonial matters.

Q: Can I file for divorce in India?
Yes. Divorce can be filed under personal laws (Hindu Marriage Act, Special Marriage Act, etc.) on grounds such as cruelty, desertion, mutual consent, adultery, or irretrievable breakdown of marriage.

Q: What is the difference between Mutual Consent and Contested Divorce?

  • Mutual Consent Divorce – both spouses agree to separate and approach the court jointly.

  • Contested Divorce – one spouse files without the consent of the other. The court examines evidence and arguments.

Q: How is child custody decided?
The court considers the welfare of the child — education, financial stability, and emotional well-being.

Q: What about maintenance and alimony?
Either spouse may claim maintenance, depending on financial needs and earning capacity.

Q: How long does the process take?

  • Mutual consent divorce: 6 months to 1 year.

  • Contested divorce: longer, depending on facts and court timelines.

Our role includes filing and defending divorce petitions, negotiating settlements for property, maintenance, and alimony, handling child custody and visitation rights, domestic violence and protection cases, as well as mediation and family counseling before litigation.

At The Legal Consortium, we ensure every client receives compassionate guidance, confidentiality, and strong representation to move forward with dignity.
